Privacy Agreement

This Agreement is a public contract in accordance with Article 633 of the Civil Code of Ukraine. By using the Services of the European Medical University (EMU) website (https://www.europeanmeduniversity.net), the Data Subject fully joins this Agreement and confirms their consent to the terms listed below.

1. The confidentiality of our website users is of great importance to us, and as the Owner and Controller of personal data, we make every effort to protect it in accordance with the Law of Ukraine «On the Protection of Personal Data». These rules explain how we use your personal information.

2. By agreeing to the use of cookies during your first visit to our website, in accordance with the provisions of these Rules, you give us permission to use cookies each time you visit our website.

3. Collection of Personal Data

3.1. The following types of personal data are subject to collection, storage, and use:

Information about your computer, including your IP address, geographic location, browser type and version, and operating system;
Information about your visits and use of this website, including referral sources, visit duration, viewed pages, and website navigation paths;
Information about your email address that you used when corresponding with us;

4.5. Your privacy settings can be used to limit the publication of your personal information on our website and can be adjusted using the privacy controls on the website.

4.6. Without your express consent, we will not provide your personal information to any third party for direct marketing purposes.

5. Disclosure of Personal Information

5.1. We reserve the right to disclose your personal information to any of our employees, directors, insurers, professional advisors, agents, suppliers, or subcontractors, insofar as reasonably necessary for the purposes set out in this policy.

5.2. We reserve the right to disclose your personal information:

in connection with any ongoing or prospective legal proceedings;
to establish, exercise, or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk);
to a buyer (or potential buyer) of any business or assets that we are selling (or considering selling);

7. International Transfers of Personal Information

7.1. The information we collect may be stored, processed, and transferred between any of the countries in which we operate to enable us to use the information in accordance with this policy.

7.2. The information we collect may be transferred to the following countries, which do not have data protection laws equivalent to those in force in the European Economic Area: the USA, Russia, Japan, China, and India.

7.3. Personal information that you consent to be published on our website may be available via the internet worldwide. We cannot prevent the use or misuse of such information by others.

7.4. By agreeing to this policy, you consent to the transfer of your personal information as described in section 7.

8. Retention of Personal Information

8.1. Section 8 outlines the company’s rules and procedures regarding the retention of personal information. These rules and procedures are designed to ensure that we meet our legal obligations related to the retention and deletion of personal information.

8.2. Personal information that we process for any specific purpose or purposes should not be kept for longer than necessary for that purpose or those purposes.

8.3. Without prejudice to the provisions of paragraph 8.2, we will generally delete personal information that falls within the categories set out below at the time specified below: personal information will be deleted at the end of the relevant month.

8.4. Notwithstanding the other provisions of Section 8, we will retain documents (including electronic documents) containing personal information:

where required to do so by law;
if we believe that the documents may be relevant to any ongoing or future legal proceedings; and
in order to establish, exercise, or defend our legal rights (including providing information to others for fraud prevention or credit risk reduction).

9. Protection of Your Personal Information

9.1. We will take appropriate technical and organizational precautions to prevent the loss, misuse, or alteration of your personal information.

9.2. All personal information you provide will be stored on our secure (password- and firewall-protected) servers.

9.3. You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

10. Changes and Amendments

10.1. We reserve the right to periodically update or amend these rules and to publish a new version on our website. You should check this web page from time to time to ensure that you understand any changes made to these rules. We may also notify you of changes by email.

11. Your Rights

11.1. The rights of data subjects are defined by Article 8 of the Law of Ukraine «On Personal Data Protection.»

11.2. In accordance with these provisions, you may instruct us to provide you with any personal information we hold about you; the provision of such information will be free of charge upon adequate verification of your identity (we typically accept a notarized photocopy of your passport).

11.3. We reserve the right to refuse to provide the information you request, within the bounds of applicable law.

11.4. You have the right to instruct us not to process your personal information for marketing purposes.

11.5. In practice, you will either expressly agree in advance to our use of your personal information for marketing purposes, or we will provide you with the opportunity to opt out of the use of your information for such purposes.

12. Third-Party Websites

12.1. Our website contains hyperlinks to, and details of, websites owned and operated by third parties. We have no control over, and are not responsible for, the privacy policies and practices of third parties.

13. Updating Information

13.1. Please inform us if the personal information we hold about you needs to be updated or corrected.

14. Cookies

14.1. Our website uses cookies. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server. Cookies can be either “persistent” or “session” cookies: persistent cookies will be stored by the browser and remain valid until their set expiration date, unless deleted by the user before the expiration date; session cookies, on the other hand, will be deleted at the end of the user session, when the browser is closed. Cookies usually do not contain any information that personally identifies a user, but personal information that we store may be linked to information stored in and obtained from cookies. We only use persistent cookies on our website.

14.2. The names of the cookies we use on our website and the purposes for which they are used are detailed below.

14.3. We use Google Analytics and Adwords on our website to:

in Firefox (version 24) you can block all cookies by clicking “Tools,” “Options,” “Privacy,” selecting “Use custom settings for history” from the drop-down menu, and unticking “Accept cookies from sites”;
in Chrome (version 29), you can block all cookies by accessing the “Settings and management” menu, selecting “Settings,” “Show advanced settings,” “Content settings,” and then selecting “Block sites from setting any data” under the “Cookies” heading.

14.5. Blocking all cookies will have a negative impact on the usability of many websites. If you block cookies, you may not be able to use certain features of our website. 14.6. You can delete cookies already stored on your computer, for example:

in Internet Explorer (version 10), you must manually delete cookies (you can find instructions on how to do this at http://support.microsoft.com/kb/278835);
in Firefox (version 24), you can delete cookies by going to “Tools,” “Options,” and “Privacy,” selecting “Use custom settings for history,” clicking “Show Cookies,” and then clicking “Remove All Cookies”;
in Chrome (version 29), you can delete all cookies by accessing the “Settings and management” menu, selecting “Settings,” “Show advanced settings,” “Clear browsing data,” and then selecting “Delete cookies and other site and plug-in data.”

14.7. Deleting cookies will have a negative impact on the usability of many websites.

15. In case of a violation of this Agreement by us, the Data Subject has the right to file a complaint with the Commissioner of the Verkhovna Rada of Ukraine for Human Rights or the court.
